Find A Treat Terms and Conditions

This document includes the terms for both the Find A Treat mobile application (“App”) and the findatreat.co.uk website (“Site”).
The App and Site are operated by Find A Treat (“we”, “us”).
We currently support users and vendors located in the United Kingdom, New Zealand, and Australia.
Features may vary by country to comply with local regulations.
1. Acceptance of Terms
By downloading or using the App, or by accessing and using the Site, you agree to these Terms.
We may update the Terms periodically. Continued use after an update constitutes acceptance of the revised Terms. If you do not agree, discontinue use immediately.
2. About Find A Treat
Find A Treat connects customers with nearby ice cream vans and mobile treat vendors.
The App provides:

Services currently operate in the UK, New Zealand, and Australia with country-specific compliance requirements.
3. User Accounts
Certain features (e.g., saving favourites, vendor registration, purchasing credits) require an account.
You are responsible for:

Keeping login credentials secure

Notifying us of any unauthorised access
4. Vendor Functionality
Vendors can:

Register a business profile and share live locations

Send location “pings” to alert customers
(Approx. 3 miles / 5 km radius — varies by country) -
Purchase ping bundles or subscribe for unlimited pings
Country-specific compliance
United Kingdom
Vendors must provide a valid Food Hygiene Rating Scheme (FHRS) ID through account settings.
New Zealand & Australia
Vendors must comply with the Australia New Zealand Food Standards Code and applicable Ministry for Primary Industries (MPI) or local health authority regulations.
Documentation (e.g., food control plan or council licence) must be supplied upon request.
We may suspend vendor accounts that fail compliance checks.
5. In-App Payments
Vendor payments are processed via Apple App Store and Google Play purchasing systems.

6. Customer Reviews
Customers may leave public ratings and reviews.
We reserve the right to:

7. Intellectual Property
All App and Site content — including branding, logos, maps, UI elements and code — is protected by UK and international intellectual property laws.
Unauthorised use or reproduction is prohibited.
8. Privacy and Data
We process personal data in accordance with our Privacy Policy.

9. Limitation of Liability
Find A Treat is not responsible for losses arising from:

10. Indemnity
You agree to indemnify Find A Treat, its owners, employees and partners against claims arising from:

11. Marketing Communications
By creating an account you consent to receiving marketing communications relevant to your country.
All communications include an unsubscribe link.
We do not sell marketing lists.

12. Governing Law and Jurisdiction
United Kingdom

13. Termination
We may suspend or terminate access for violations of these Terms or applicable laws.
You may delete your account at any time via the App or by contacting support.

15. Website-Specific Terms
Orders & Payments
Website orders (e.g., merchandise or hardware) are processed via Stripe in GBP, NZD or AUD depending on shipping country.
Pricing & Availability
Prices may change without notice.
Pricing errors will be corrected and customers offered the option to proceed or cancel.
Delivery & Shipping
Shipping varies by country.
We are not responsible for carrier or customs delays.

16. We reserve the right to suspend or delete accounts that have been inactive for a continuous period of 90 days. We may attempt to notify users before deletion. Any remaining data will be handled in accordance with our Privacy Policy.
16. Wishes
1. What are Wishes?
Wishes are digital credits purchased within the Find A Treat app. Each Wish allows you to send a “Request a Van” notification to nearby active vendors. Wishes are digital content supplied to your account immediately after purchase.
2. Purchasing Wishes
1. Wishes are sold in packs, including 10 Wishes for £1.99 and 20 Wishes for £2.99. Available pack sizes and prices may vary from time to time.
2. All purchases are processed through the Apple App Store or Google Play Store using in-app purchases.
3. By tapping “Purchase Wishes”, you request immediate access to your Wishes and acknowledge that you will lose your 14-day right to cancel once the Wishes are supplied to your account.
4. Wishes are generally non-refundable once supplied, except where required by law, where they are not delivered as described, or where Apple or Google approves a refund under their own policies.
5. Wishes do not expire and remain on your account until used, unless your account is closed due to misuse, fraud, or breach of these terms.
6. Wishes have no cash value, cannot be exchanged for money, and can only be used within the Find A Treat app.
3. Using Wishes
1. One Wish is consumed each time you successfully send a Request a Van signal to nearby active vendors.
2. If there are no active vendors nearby at the time you attempt to send a Request a Van signal, your Wish will not be consumed.
3. Nearby active vendors are notified of your request. Arrival is not guaranteed and Find A Treat accepts no liability if a vendor does not respond or attend.
4. A Wish cannot be refunded once it has been successfully used to send a Request a Van signal to nearby active vendors, except where required by applicable law.
4. Location Data
1. When you send a Wish, your approximate location is shared with nearby vendors so they can assess whether to respond to your request.
2. Your location is used for the purpose of sending and managing the request.

5. For Vendors
1. Vendors are notified of Wish requests but are under no obligation to accept, respond to, or attend any request.
2. If a vendor accepts a Wish request, they should make a reasonable effort to visit the requested area where practical and commercially reasonable.
3. Repeated acceptance of Wish requests without reasonable fulfilment may result in account review, restriction, or suspension.
4. Find A Treat is not liable for any loss of earnings, missed sales, travel costs, fuel costs, route changes, or other losses arising from Wish requests, whether accepted or not.
6. Our Liability
1. Find A Treat’s liability in relation to Wishes is limited to the value of the Wishes purchased where we have failed to deliver the Wishes or the Wish feature as described.
2. We are not responsible for vendor behaviour, vendor availability, route changes, weather, traffic, stock availability, customer availability, or circumstances outside our reasonable control.
3. Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or your statutory rights as a UK consumer.
7. Changes and Availability
1. Find A Treat may modify Wish pricing, pack sizes, functionality, or availability at any time.
2. We will honour Wishes already purchased before any changes take effect.
3. We may withdraw or suspend the Wish feature where necessary for technical, legal, operational, security, or misuse-related reasons.
8. Governing Law
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the courts of England and Wales.

Severability
If any provision is invalid, the remaining Terms remain enforceable.
